By accessing or using cation-chat.vercel.app (the "Service") operated by Cation ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.
Throughout these Terms, "Bond(s)" refers to the AI companion(s) (also referred to as an AI chatbot(s)) that you create and interact with on the Service.
Although a Bond may have human-like traits, chat with you, or otherwise respond to you like a human, at no time are you interacting with an actual human. A Bond, like all large language models, can make mistakes and should never be relied on for medical, mental health, legal, or other professional advice, or relied on for reminders or emergencies.
IF YOU ARE FEELING SUICIDAL, LIKELY TO HARM YOURSELF OR OTHERS, IN NEED OF MEDICAL ATTENTION, OR EXPERIENCING ANY OTHER EMERGENCY, YOU SHOULD IMMEDIATELY CONTACT A LICENSED PROFESSIONAL, YOUR LOCAL EMERGENCY SERVICES, OR AN appropriate CRISIS HELPLINE. DO NOT RELY ON THE SERVICE IN AN EMERGENCY.
Cation provides SaaS / software services through our platform, allowing you to create and converse with your own Bonds. The Service is currently provided on a free basis. We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time with or without notice.
You must be at least 18 years old to use this Service. By creating an account or using the Service, you represent and warrant that you are 18 years of age or older. We do not currently verify age at signup. We are not responsible for a user's misrepresentation of their age at signup, and we do not take responsibility for underage use of the Service that results from such misrepresentation.
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

A breach of these Terms may result in immediate suspension or termination of your account, without notice and without any obligation to refund or compensate you.
If you submit any feedback, suggestions, ideas, or other input about the Service ("Feedback"), you agree that such Feedback is given voluntarily, without expectation of compensation, and that we may use it for any purpose, including improving the Service, without any obligation to you.
The Service and its original content, features, and functionality are and will remain the exclusive property of Cation. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
User-generated content (including your messages and any content generated by your Bond) remains your property. However, you grant Cation a limited, worldwide, royalty-free license to access, process, store, and analyze this content for the purpose of operating, maintaining, and improving the Service, including analyzing chat data to improve our underlying prompts, model behavior, and overall product quality. This license does not permit us to sell your content or publicly attribute it to you.
To generate responses, your recent conversation history is sent to one or more third-party AI providers for processing, as described in our Privacy Policy. These providers may have their own data handling and retention practices, which we do not fully control when using fallback providers.
The Service is currently provided free of charge. If we introduce paid plans in the future, updated terms covering billing, fees, and refunds will apply and will be presented to users before any charges occur.
You may stop using the Service at any time. We may suspend or terminate your account at any time, with or without cause or notice. Upon termination, your data will be handled in accordance with our Privacy Policy, which currently provides that your account, Bonds, and chat history are deleted upon account deletion (whether self-service or requested by you via email), except for data already processed by a third-party fallback AI provider prior to deletion.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied. Cation expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that: (a) the Service will function uninterrupted or error-free; (b) defects will be corrected; (c) the Service is free of viruses or other harmful components; (d) any output generated by a Bond will be accurate, appropriate, or lawful.
To the maximum extent permitted by applicable law, Cation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
To the maximum extent permitted by applicable law, Cation's total cumulative liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount, if any, that you have paid to Cation in the twelve (12) months preceding the event giving rise to the claim. Because the Service is currently provided free of charge, this amount is currently $0.
You agree to defend, indemnify, and hold harmless Cation and its owner, contractors, agents, and representatives from and against any losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party site, and any interaction with a third-party site is at your own risk.
We may assign these Terms, in whole or in part, at any time without restriction, including in connection with a sale, merger, or transfer of the Service or our business. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
These Terms shall be governed and construed in accordance with the laws of Punjab, Pakistan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Punjab, Pakistan, except that either party may seek injunctive relief in any court of competent jurisdiction.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Provisions of these Terms that by their nature should survive termination (including, without limitation, Intellectual Property, Feedback, Limitation of Liability, Indemnification, and Governing Law) shall survive any termination of your account or these Terms.
We may change or update these Terms from time to time, and we reserve the right to do so at any time. If we make material changes, we will provide notice through an appropriate channel and post the updated Terms on the Site.
If you object to any changes, you should stop using the Service and delete your account. All changes to these Terms are effective immediately upon posting, and continued use of the Service after a notice of material change or posting of updated Terms constitutes your consent to the changes.
